Tip for Sellers: Dark Cluttered Office Transformed with Paint & Staging Help

This is one of the rooms in a Portland OR home we staged last week ... but the transformation is quite dramatic!  Not only that, it was quick and easy, too ~ something anyone could do before putting your home on the market.

The main floor bedroom was being used by the sellers as a home office -- perfect use for the space.  It was painted about 8 years ago when dark red was a very popular color.  It was also overstuffed with furniture, making the space look much smaller than it really was.

We recommended a lighter paint color to brighten up the room, and removal of the existing furniture.  We then staged it lightly, letting buyers see the function of this space as an office.

Contra Costa County Probate Sales

Selling a Home in Probate is a little different than normally Selling a Home.  Here is a great post on Selling a Home in Probate.  It was written by an Alameda Agent but is generally applicable in Contra Costa County.

PROBATE SALES

 

 

PROBATE SALES   Probate sales of homes in California are regulated by the Court and they may have special requirements but are basically like a regular sale. This article concerns probates governed by the Independent Administration of Estates Act(IAEA).

 

Probate SalesThe Administrator/Executor is exempt from providing a buyer with a Transfer Disclosure Statement, Natural Hazard Disclosure and Mello-Roos disclosures.  The Administrator/Executor does not need to provide the Buyer with a completed Earthquake Guide and is exempt from providing the Buyer with smoke detectors.  Of course Agents are not exempt and must provide all documents that are required of any sale.  Additionally, local law may have requirements that the Seller may have to comply with.  The Administrator/Executor should check with the municipality to determine their responsibility.

 

 

ESCROW REQUIREMENTS OF A PROBATE SALE:  The title company will require that they are provided with the Order for Probate of the Estate, they will also request an original "Letters Testamentary" or" Letters of Administration", which ever applies.  When the estate is governed by the Independent Administration of Estates Act(IAEA), usually there will be NO requirement for court confirmation of a sale. 


The attorney for the estate must provide the title company with the following:

 

  • An original 'Letters' with the Administrator/Executor's name and a letter that they have been granted full authority to administer the estate under the provisions of IAEA
  • A copy of the Notice of Proposed Action for the sale of the property
  • Letter from the attorney for the estate stating the following:

           a.  The Administrator/Executor has full authority and the full authority has not been revoked

           b.  That all of the individuals or entities entitled to receive notice have been given notice in a timely manner and that there were no objections lodged to the action.

           c.   There are sufficient assets to satisfy any federal and/or California taxes due.

  • If the decedent used their Social Security number as their Tax ID number, then  the estate will have to request a new Tax ID number.

SALE OF A HOME HELD IN A TRUST

 

A sale of a home held in a trust is very common.   As an estate planning technique, many people have put their assets, including their homes, in a trust.  The trust then becomes the owner of the home.  This is usually done to protect the estate from a probate, a costly and public court proceeding.  

 

A sale of a home held in a trust may have certain requirements.  Even though trusts are not controlled by the courts there are rules that must be complied with.   The attorney who will be doing the trust administration will advise the family what must be done. 


 A sale of a home held in a trust will necessitate that an agent request a property profile which will show that the property is, indeed, held in a trust. 


If the owner of the home has passed away, the successor trustee must be identified because that person will be the person who may sell the property.  The trust will identify the name of the successor trustee.  That person may be the remaining Trustor spouse or an individual appointed by the original Trustors. 


According to Placer Title Company, a title company may require certain trust documents to be provided to them: 

  1. The title company may ask to see the trust to verify that the person who is acting as trustee is actually named in the trust.
  2. The title company may require a Certification of Trust signed by the successor trustee(s) and the attorney for the trust estate.
  3. The title company may require a death certificate if the original Trustor(s) is/are deceased.
  4. If the trustee is incapacitated, the trust will govern the succession of trustee(s).
  5. If a trustee resigns, the title company may require an acknowledgment of resignation.
  6. A Tax ID number may be needed if the original Trustor(s) is/are deceased.
  7. Disbursement of funds at close of escrow must be issued in the name of the trustee of the trust, so a trust account must be opened to receive funds.
  8. Questions may arise if a power of attorney may be used in the sale of trust property.  According to Placer Title Company, "Unless the trust specifically provides that the trustee can appoint an attorney in fact, a power of attorney cannot be used."  

This information applies to Alameda County, California.  Other areas may have entirely different rules.  The Successor Trustee should consult with an attorney in the area in which the property is being sold.  I am not an attorney and do not give legal advice.

Top 10 Predictions for 2012

Top 10 Predictions for 2012

In 2010 I made some top predictions in 2010 and you should take a look at them and you will appreciate the top 10 for this year more. Not sure why I did not do them in 2011.

Here is the Top Ten Predictions for 2012:

  1. Liberals in an effort to achieve equality will demand the government provide Free Medical Marijuana for those that cannot afford it. Truck loads of confiscated Cannabis will be dropped off at the Occupy Movement encampments.

  2. The American People will finally find a person with no Sex Scandals, Past Drug Use, or any mistakes in his life and want him to run for President. Press will still accuse him of something and question the nature of his relationship with questionable people in his life. Jesus will refuse to run!

  3. Lacking any Family Values Oriented positions Democrats will tout Bill Clinton as a Role Model for young American Men for holding his marriage together in the face of those old accusations into private and personal matters.

  4. As a result of too many injuries and reduction in the quality of life for former NFL Players the NFL will make yet more Safety Rules. Soon Players will just wear big rubber suits that have them all looking like the Michelin Man with flags Velcrowed to it. Just pull off the flag for a tackle.

  5. Donald Trump will launch a new TV Series – Celebrity Presidential Candidate. The Donald will put Gary Busey, Drug addicted Starlet de jur, and a bunch of other B list Hollywood loosers through a series of asinine test. The winner gets Trump's endorsement for President.

  6. No matter how good the match ups look at the start of the season NFL Monday and Thursday night games will continue to be pathetic match ups forcing the NFL Network to run more re-runs of Canadian Football.

  7. A terrorist attack will take down the cell phone texting interface effectively eliminating Texting. High school kids will go into shock – school districts will rush in counselors to teach them how to interact in a face to face environment and ease them through being disconnected from the collective.

  8. Politicians will raise taxes and claim they are doing it to for the children.

  9. Major League Baseball will expand it's playoff format to 16 teams – meaning that there will be more baseball games to ignore during football season. The World Series will now be Called the Christmas Baseball Championship Series.

  10. Winning agents will still be found working hard at Active Rain.

Summerset Homes are part of a popular 55+ Community in East Contra Costa County. Summerset Communities are gated communities on Golf Courses, with pools, club houses, hot tubs, billiards, biking and hiking trails, and a number of recreational activities.

Summerset Homes in the Heart of Brentwood Ca is close to fine dinning, shopping, entertainment, and close to San Francisco and the High Sierra for the best of everything California has to offer.

Often times I look at trends from month to month and can miss the big picture of long term trends. Well here are some charts and figures for the last two years on a quarterly basis.

These numbers are for Homes in Summerset. There is probably still some reporting due on for the 4th quarter of 2011, which could alter the numbers.

Prices and number of sales on Summerset Homes are up and down, tending to spike in the summer. There has been a gradual price decrease on a SF basis over the last two years. Although the 4th quarter numbers of 2011 are down significantly, this should not yet be viewed as a downward trend in the Summerset Real Estate Market. The downward trend in pricing may be due to the sale of larger homes. Large Homes tend to sell for less on a SF basis and I think Larger Summerset Home Sales have picked up as people looking for an excellent quality of life at a good price are moving to Summerset in Brentwood Ca.

Brentwood Ca Home Sales 94513 – For 2010 and 2011

Brentwood Ca Homes are some of the most popular Homes in East Contra Costa County. Brentwood offers some of the nicest and most affordable homes for the money in Contra Costa County.

Often times I look at trends from month to month and can miss the big picture of long term trends. Well here are some charts and figures for the last two years on a quarterly basis.

These numbers are for Single Family Homes in Brentwood – under one acre. There is probably still some reporting due on for the 4th quarter of 2011, which could alter the numbers.

Prices and number of sales on Brentwood Homes are up and down, tending to spike in the summer. There has been a gradual price decrease on a SF basis over the last two years. However, this should not be viewed as a downward trend in the Brentwood Ca Real Estate Market. Brentwood Ca has excellent well priced large homes, some of the best buys on Large Homes in Contra Costa County. Large Homes tend to sell for less on a SF basis and I think Large Brentwood Ca Home Sales have picked up as people looking for an excellent quality of life at a good price are moving to Brentwood Ca.

Gas Meters and Earthquakes in California

Here is some great advise for anyone living in California or Earthquake Country.  Big ones don't come often but when they come we need to be ready.

Via Dan Edward Phillips, Realtor and Broker/Owner (Dan Edward Phillips):

In the event of a major earthquake (in this area of Northern California it is just a 'matter of time'), it may be necessary to shut off the gas line to your home at the gas meter.

Everyone in the family should know how to shut off the gas service.

Make sure every member knows where the gas meter is.  It is also a good idea to leave directions on the location of the gas meter in an obvious location (like the refrigerator) if you will be gone and a relative or neighbor will be 'watching' the house. 

Do not block access to the meter with shrubs or plants, make sure it is easy to locate.  Paint the 'shut off valve' a bright color and attach a wrench to the meter to use to shut off the gas flow in case of an emergency.  Being able to shut the gas service off quickly may save your home.

In the event you do shut off the gas flow, contact the local gas company if you are unsure of how to relight the pilots.  Some pilots are auto start but not ALL!  Do not take any chances.

I was looking for one more Classic Christmas Carol to post when I came across what is below. It is very moving and I have a tear in my eye as I post it.

At this time of year I really reflect on the Freedom we have to love God. I know that even in the most oppressive places in the world as we focus on his birth this time of year that the name of Christ lifts many hearts.

Our Freedom comes from God; but I believe one of his instruments in many cases is the United States of America and our Soldiers.

The Classic Sounds of Christmas – The Little Drummer Boy

The Classic Sounds of Christmas – The Little Drummer Boy

I love all sorts of Christmas Music religious and secular. The joy of many of the old religious classics is that they are so filled with eternal truths to remind us that there is a living God.

The Little Drummer Boy is another one of my all time favorites. The song is not very old in terms of Christmas tunes only going back about 60 years, but it has an interesting history and may be tied to older folk music. Unlike some of the other songs I have featured this one is a fictional narrative placed within historic Christianity, but it certainly reflects the spirit of the Gospel.

There are many different versions done by many different artist. Here is Johnny Cash's version.
